This Policy applies to your use of Our retail locations, websites, features, and mobile applications (each referred to as an “App”).

We offer a mobile application and related website (“Virtual Vision Test app,” previously known as the “Prescription Check app”) and a retail store service with a related website (“In-Store Prescription Check,” together with the Virtual Vision Test app, referred to as “Virtual Vision Test”), which you may use to perform a vision test that could help update your eyewear prescription. This Privacy Policy also applies to your use of Virtual Vision Test. Collectively, the retail locations, websites, Apps, Affiliates that display or contain a link to this Privacy Policy, and the Virtual Vision Test are referred to in this document as the “Services.”

Your use of Virtual Vision Test is subject to our Virtual Vision Test Terms of Use. Any other use of the Services is subject to our Terms of Use. Our use of any individually identifiable health information you provide is subject to the requirements of the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”). Additionally, Our Notice of Privacy Practices will govern the handling of such information.

This Privacy Policy does not apply to information collected or received through other means, anonymous or de-identified data, or information collected by third-party websites (“Third-Party Services”), such as Facebook, Twitter, Pinterest, Instagram, Snapchat, and Google+. Even if you access these platforms through Our Services, We do not control them, so we encourage you to review their privacy policies carefully.

Furthermore, some optometrists and ophthalmologists (“Eye Doctors”) performing medical services at Our locations operate independent practices (“Independent Practices”). This Policy does not apply to these Independent Practices or their websites or mobile apps. Please consult their respective privacy policies for information on how they use customer data.

From time to time, we may update this Policy to reflect changes in how we collect, maintain, or store information. Any changes will be reflected by the revised effective date at the top of this Policy. Changes will be effective once posted.

1. Information Cyclesfashion Collects

Information You Provide Us: We collect information that you share with Us via the Services and other forms of communication. For instance:

When you create an account with Us, we collect your first and last name, email address, and password.
You may provide additional information when you book an eye exam, such as your phone number, address, and date of birth.
If you make a purchase, we may request payment details like credit card information, billing, and shipping addresses, though we do not store payment card details.
If the information you provide relates to your healthcare, including vision care or payment for such services, it will be treated as Protected Health Information, governed by our Notice of Privacy Practices.

Additionally, some features of Our Apps may ask for your permission to take a photo, facial scan, or other images of you. For example, Our Virtual Try-On feature uses your camera to analyze facial data points. These scans or measurements are not stored and are only used while you engage with the feature.

When you use the Virtual Vision Test app, we may collect certain health-related information, such as the answers you provide in the Eligibility Questionnaire, your performance during the Vision Test, and communications with Our Eye Doctors. This includes information necessary for an Eye Doctor to issue or renew a prescription.

Information From Third Parties: Your Eye Doctor or other third parties may share information with Us to facilitate our services. Additionally, if you link a Third-Party Account, such as a Google or social media profile, with Our Services, we may receive related information, including your profile and interaction data.

Information We Collect Automatically: We collect information such as device details, IP address, and browsing behavior. For example:

When you connect to our in-store Wi-Fi, we receive information about your device, such as its MAC address and browsing activities.
We use technologies such as cookies and web beacons to collect data on how you interact with our websites and mobile applications.
In addition, video surveillance is used in our stores for security and to better understand customer behavior.

We do not knowingly collect information from children under the age of 18. Parents or legal guardians may use our Services on behalf of minors.
